      <description>When you buy a PC, chances are darn good that the service package will be neither very convenient nor inexpensive. Most in&#45;home or in&#45;office service plans amount to little more than a local repair shop guy traipsing through your front door on a first&#45;available basis. Even carting the computer to an in&#45;store service center does not guarantee fast or efficient service. So when Mr PC QuickFix Online PC Services offered me an opportunity to try our their remote repair program, I sheepishly accepted.

Working from a very active home office, I break out in a sweat at the slightest sign of distress from my bank of desktop and laptop computers. Each one runs dedicated tasks. So I regarded this chance to test a remote repair service with both enthusiasm and trepidation. Could I really trust some stranger sitting at a computer console in Tenby, Dyfed, to wander around one of my hard drives? I am no stranger to maintaining my own computers and using remote access. So I selected my no&#45;name desktop &#45;&#45; often the first point of entry to programs I download and test &#45;&#45; as the patient and scheduled a diagnostic health check.

The Rundown

Mr PC QuickFix offers a premium remote PC and technology repair service for the home, home office and small office. The company offers several dozen repair options and configurations for help with desktops, laptops and peripherals.

The computer experts are Microsapplication trainers, Microsoft product specialists, A+/MCP/MCSE certified professionals, network administrators and HTML developers. Every technician is pre&#45;qualified, has more than three years of help desk environment experience and completes a two&#45;week training course on service delivery and the virtual interface, according to the company.

On average, the fees Mr PC QuickFix charges are less costly than those at repair shops and other service plans I&apos;ve used over the years. For example, a diagnostics session costs US$29.95. Removing spyware and virus infections costs $99.95. A PC tune&#45;up runs $129.95.

For an annual subscription to the Mr PC Fixit SmartPlan Subscription, you get unlimited online computer support. and a complete software security suite for your PC. Of course, you pay &amp;pound;50.00 for a one&#45;time setup fee that includes the first month free. A home PC user can select the Protect &amp;amp; Assist Subscription of &amp;pound;10.00 per month.

Ordering Help

The log&#45;on procedure was quick and simple. After I logged onto a Citrix home page and clicked the Get Started button, I was presented with a screen requiring my basic personal details and the nature of the computer help I wanted. A drop&#45;down menu listed all of the available services and their costs.

One more click presented a scheduling page already adjusted to the service request I was making. I could choose the date and available times for the service to be performed. I was impressed at the flexibility and the ability to put me in charge of the scheduling.

I decided to have a PC tune&#45;up performed. I initiated the service request at 1:15 p.m. on a Monday and wanted the job to begin at 2 p.m. the same day. But the next available time slot that day was 3 p.m. &#45;&#45; still not a bad wait if my repair need was urgent. Where else could I get such quick help?

The Hook&#45;Up

The service session began with a call to my designated phone number at precisely 3 P.M. My personal service technician, asked me a few questions to confirm the symptoms. In my case, I replied that I thought the computer had slowed down and wanted to return it to its earlier performance level.

My technician was pleasant and friendly throughout the repair session, directed me to enter the Mr PC QuickFix Web site and enter a special service code he dictated. That established a 128&#45;bit SSL (secure sockets layer) encryption connection through which he uploaded a diagnostic application to my computer&apos;s hard drive.

I had a choice to make. I could stay on the phone and talk to him while he worked on my computer, or I could hang up and wait for him to call me back when the session was completed. I am the kind of guy who likes to hang around my auto mechanic and pester him with questions while he works on my car. So I gave him the same treatment.

Visibility Counts

Everything the technician did remotely I watched on my computer screen. No stranger to diagnostic tools, I followed his actions with approval &#45;&#45; mostly, that is. Every now and then he checked a program or service for deletion to which I said no.

The technician ran what amounted to a series of standard tools that looked at control panel settings, startup routines, program files and performance benchmarks. Included in the technician&apos;s bag of tools was the Hijack This malware scanner.

Since my computer had nothing wrong with it, the tune&#45;up services merely performed remotely the same tasks that I run on the equipment periodically. I have numerous specialty applications installed on my computers to add features not normally active on non&#45;work computers. The diagnostic scans listed these very programs as possible intrusions, such as plug&#45;ins to my e&#45;mail Learn how you can enhance your email marketing program today. 

Had I not remained on the phone line during the health check&#45;up, He may have removed them. He noted that these specialty programs no doubt hogged some of the system resources and might be causing slower performance. However, since I had used the slow&#45;down as my reason for the check&#45;up, I already knew the computer was running at near&#45;peak performance.

The Results

After some 45 minutes, the technician had identified two questionable files but little else. He removed several older versions of Java Latest News about Java runtime installations that were adding to the hard drive and startup clutter. Normally, Java should remove these earlier versions when it completes an upgrade.

From a healthy PC standpoint, He found very little to &amp;quot;fix.&amp;quot; The hard drive was not overly fragmented. Some minor clutter in the Internet cache was evident.

Hei did remove an installation of Pit Stop diagnostics module and an installation of SpyBot. I didn&apos;t object because I was intending to install the newest versions of both anti&#45;malware scanners anyway. But I thought it interesting that the technician removed legitimate programs from other malware detection vendors.

Final Observations

All the tasks the technician performed in giving my computer a tune&#45;up were standard maintenance operations. In fact, several of the tools remotely activated on my computer are part of the Windows operating system for system maintenance.

However, uninformed home users and harried business users not familiar with routine computer maintenance would be well served by Mr PC QuickFixs&apos;s diagnostic service. Anyone with a real computer problem would stand an excellent chance of getting satisfaction.

I was won me over on two counts. The first thing he did was set a system restore point. That reassured me of his competence. The second winning factor was his assessment that the PC was obviously well maintained. Bogus added service pitches never entered the conversation.

All things considered, I would not hesitate to revisit Mr PC QuickFix if a malfunction befell my computers. The bulk of service offerings is for the Windows platform. Linux service is available for some but not all conditions. No remote service for Macs is yet available.

Mr PC QuickFix can fix 374 software and 17 hardware platforms. That&apos;s a substantial service help line for remote repair assistance around the clock with little or no waiting for a solution.</description>

First, the ability to market your establishment as a FREE HotSpot will attract more customers to your location, which will increase sales of products and services you already sell.             How can free&#45;hotspot.com enable my business to generate a new revenue stream?
            We share the revenues that are generated from the advertisements that we deliver across our network with our HotSpot Partners. Because advertisements are geographically specific and wireless user specific, we are able to attract both local and multi&#45;national advertisers, typically at a premium rate. free&#45;hotspot.com Operator Partners have the right to control ad type, frequency, and content served to their subscribers; therefore, even revenue generation is controlled directly by the Operator Partner &amp;ndash; you will always have total control over the volume, type, frequency, and content of the ads served to your customers.
            
            Do I need to purchase any special equipment to become a free&#45;hotspot.com Operator Partner?
            No. We give you the equipment, provide in&#45;store promotional materials, list your location in our directory and all HotSpot directories and sell the available advertising. Operators are responsible for the cost of the actual Installation (through one of our local partners) and of course the cost of the monthly broadband connection.
                         
            
            What sort of commitment is required when I sign up?
            Unlike many other HotSpot programs, we do not require a lengthy commitment to participate in out network. The initial term of our agreement with you will be 12 months, after which we can renew. Moreover, since we are a FREE HotSpot network, there are no volume commitments such as required by other wireless providers. Your FREE HotSpot will never cost you anything &amp;ndash; regardless of how many people use the service.
            
            What if I have technical problems with my FREE HotSpot?
            Our trained installation partners will make sure that your HotSpot is up and running at all times. These local contacts not only perform the installation; they also provide maintenance, upgrade and repair services.
            
            What if a customer has problems logging on?
            Remember, our goal is to make running a FREE HotSpot as easy as possible! That&amp;rsquo;s why we have trained technical support personnel available both online and by phone. Remote computer support, also known as &apos;online support&apos;, allows us to remotely view your computer screen and securely fix most computer and network problems right through the Internet via remote control. In fact, it&apos;s like watching your computer fix itself! This type of computer support works through &apos;desktop sharing&apos; technology. What this means is that when you &apos;log in to our secure online support center&apos;, you can allow a technical support representative to &apos;view&apos; and &apos;interact&apos; with your computer remotely via the Web &#45; fixing problems fast.
  How long does an average support session last?
The average remote support session lasts anywhere from 30&#45;60 minutes. However, depending on the type of problems you&apos;re experiencing, a session may be shorter or much longer. In some cases where the computer problems are severe (read: lots of spyware!), we may recommend a follow up remote session or scheduling an in&#45;home or in&#45;office visit by a certified technician.
  How much does it cost?

  Can you get back into my computer after my session is over?
No, not until you log in again and request service. When you log in to MR PC Fixit&apos;s secure online support center you are prompted to  download a temporary desktop sharing application and supporting tools that allow us to view and interact with your computer. Once your service is  complete and you log off, the temporary application and accompanying tools are automatically deleted from your PC. We can no longer see or access  your computer.
  Is it secure?
Yes. When you log in to our Secure Online Support Center your are initiating a 128&#45;bit encrypted connection between your computer and the technician&apos;s computer. In this way, you have set up a unique one&#45;to&#45;one session that no one else can view or access during the session. That ensures your security and privacy.
  In addition, you are in control the whole time. Only you can initiate a remote support session and you can end a session by simply closing the support window on your desktop. Further still, you are always in control of your mouse (cursor). During your session you will see the technician using your cursor to locate and fix problems. Contention Ratio Explained

Contention is something that appears to be only talked about in the UK, but it is a major part of the Internet. Without contention at the various points of the Internet it would be vastly more expensive to run and very few people would even have access to a 500kbps service.  

With respect to BT Wholesales Home services which run at a nominal 50:1 contention, the worst case that contention can produce is a 0kbps throughput. 

There is no active management of the contention. The way the contention is managed is such that you should not expect to see below 100kbps, of course BT Wholesale and your ISP can do nothing about a website or server that supply the data slower than that.  
An urban myth has grown up that the 0.5Mbps service is shared between 50 users, the contention on BT IPStream 0.5Mbps services is done very differently.  

How is BT Wholesale Contention carried out  

The 50:1 contention of a Home service refers to the BT Wholesale controlled part of the network, between your local phone exchange and one of 22 locations around the UK (these 22 locations are called Points of Presence or POPs), where the connection is handed onto the various Service Providers. At many exchanges and in the BT Wholesale controlled part of the network the contention is so low, that most of the visible contention is actually taking place in the ISP controlled segments.  

To avoid problems with one user hogging all an exchanges bandwidth, the users are contended on a larger than 0.5Mbps pipe. The normal basic pipe for a 50:1 service is 4Mbps (though with the introduction of a 1Mbps 50:1 service this may increase), this pipe will be populated with an absolute maximum of 400 x 0.5Mbps users, it is more common that only 200 to 300 users are placed on each 4Mbps pipe. The fact that each user is capped by their connection over the ADSL to the exchange means that no one user can saturate the pipe, and therefore the chances of you receiving your full 0.5Mbps is more likely.  

The pipe sizing is different for the Office 20:1 contention services, which run at 0.5, 1 and 2Mbps. In that case the normal minimum pipe size is 10Mbps.  BT Wholesale does monitor the bandwidth levels in the various pipes and can adjust them up and down to cope with increases in the usage level, though it may take sometime for action to be taken. It is also possible that there may be several 50:1 pipes leaving the exchange, this can mean if you are seeing contention that not all other users on your exchange will be, and sometimes users on the same ISP and same service may actually be on a different pipe connecting to the ISP.  

With the new Home 1000 product these users are running on the same pipe as the 0.5Mbps users, so we can expect to see some pipe resizing going on, if a lot of users transfer to the Home 1000 service.  You may also see the pipe referred to as the backhaul, PVC or Virtual Path. BT at most exchanges has capacity installed for up to 155Mbps of traffic from ADSL users, and the smaller subtended exchange builds have around 30Mbps of bandwidth available. Which should be sufficient for most exchanges. A new survey by Liberty Europe, a leading wireless broadband provider, has found that nearly all (97%) of the business professionals surveyed want to have easy access to broadband internet when they are not in the office, so they can send and receive emails and download large presentations. Almost all the respondents to the survey would be happy to pay for this service and four out of ten would pay over &amp;Acirc;&amp;pound;4 an hour.  Over half said their preferred destination for connecting to the internet would be a hotel as they are likely to be there for some time. 70% said they need to have at least 15 to 30 minutes free to make it worth their while to start using the laptop. Our objective was to experiment with our Portal and get as many pages into the search engines as quickly as possible. We could have completed our portal, optimised it for SEO and intoduced it to the search engines. On a 5 months build programme and a quoted three months to be indexed. It would have been eight months before anyone could find us, no good to man or beast.Our aproach had to be proactive and agressive.As we are in the business of selling UniquEmails each of which has a URL we have multiple domains (100&apos;s) all of which we need to point towards UniquEmail portal and be introduced to the search engines.Our Portal build was to consit of 5 main websites. Five web servers were duly installed with dummy index pages on each. The urls for these sites were introduced to the search engines early (apx three months prior to launch). The pages were duly indexed by the engines and gave us a single entry for each of the five web sites.During this process our portal development continued on our main webserver with the base url of UniqEmail.in. Our goal now was to redirect the other four URL&apos;s to the main server with out upsetting the search engines. Redirect &amp;quot;The Normal Method&amp;quot;Redirects are deployed on the webserver so that when a visitor lands on website1.com visitors are redirected to website 2.com.Search engines don&apos;t like redirects an aceptable protection mechanism to protect users from landing on an adult site when the url indicates something totally different. There are methods of aliasing the redirect landing page URL but the search engines can detect the alias and will not allow the redirect URL to be indexed. In fact if they get realy upset and have the ability to ban you from the search engines all together.Redirect &amp;quot;Our Method&amp;quot;Expression Engine is a Content Management Portal built with php a serverside processor language. How does this help us ?Unlike the nomal redirect with php we can deploy a Global Command that converts the URL for the whole site to that of the landing page URL. Therefore unlike the redirect method when a visitor lands on website1.com they are redirected to website 2.com the website URL (address) once redirected doesn&apos;t change to website 2.com it remains website1.com.Utilising this method we can now introduce all of our website urls to the search engines without upsetting them.Google Site MapsThe next phase was to devise a methodology to easily and quickly introduce all of our web pages for each of our websites to the search engines.Google is generally the hardest to crack so Google Sitemaps were targeted as the method of introduction for the Google web crawler.A sitemap is a programme that creates a full tree view of each of your webpages in a format that Google can read. Google like sitemaps because they speed up their crawling process when they visit your website. We built an atomated sitemap programme that Google indexed for each of our five websites. The result was that within a 5 day period we had over 250 webpages indexed on various URL&apos;s all pointing towards our Portal.RSS 2.00 Syndication Syndication is known a push technology it is a simpler version of Google Sitemaps. RSS fuction is to allow website visitors to bookmark all of your web pages with a click of a button however its ability to&amp;nbsp; builds a Tree view of your website pages has been harnessed by Yahoo and MSN. Inroducing your RSS page to these search engines  ensures that all of your pages are inexed quickly.Fraggggggle and SEOBackward Links are the most important factors to achive a Page Ranking in the Engines. Backward links are links that point to your website from other websites (excluding your own pages).Page Ranking takes far longer to achieve however we managed an initial rank within the first week !. Contention is something that appears to be only talked about in the UK, but it is a major part of the Internet. Without contention at the various points of the Internet it would be vastly more expensive to run and very few people would even have access to a 500kbps service.  With respect to BT Wholesales Home services which run at a nominal 50:1 contention, the worst case that contention can produce is a 0kbps throughput. There is no active management of the contention. The way the contention is managed is such that you should not expect to see below 100kbps, of course BT Wholesale and your ISP can do nothing about a website or server that supply the data slower than that.  An urban myth has grown up that the 0.5Mbps service is shared between 50 users, the contention on BT IPStream 0.5Mbps services is done very differently.  How is BT Wholesale Contention carried out  The 50:1 contention of a Home service refers to the BT Wholesale controlled part of the network, between your local phone exchange and one of 22 locations around the UK (these 22 locations are called Points of Presence or POPs), where the connection is handed onto the various Service Providers. At many exchanges and in the BT Wholesale controlled part of the network the contention is so low, that most of the visible contention is actually taking place in the ISP controlled segments.  To avoid problems with one user hogging all an exchanges bandwidth, the users are contended on a larger than 0.5Mbps pipe. The normal basic pipe for a 50:1 service is 4Mbps (though with the introduction of a 1Mbps 50:1 service this may increase), this pipe will be populated with an absolute maximum of 400 x 0.5Mbps users, it is more common that only 200 to 300 users are placed on each 4Mbps pipe. The fact that each user is capped by their connection over the ADSL to the exchange means that no one user can saturate the pipe, and therefore the chances of you receiving your full 0.5Mbps is more likely.  The pipe sizing is different for the Office 20:1 contention services, which run at 0.5, 1 and 2Mbps. In that case the normal minimum pipe size is 10Mbps.  BT Wholesale does monitor the bandwidth levels in the various pipes and can adjust them up and down to cope with increases in the usage level, though it may take sometime for action to be taken. It is also possible that there may be several 50:1 pipes leaving the exchange, this can mean if you are seeing contention that not all other users on your exchange will be, and sometimes users on the same ISP and same service may actually be on a different pipe connecting to the ISP.  With the new Home 1000 product these users are running on the same pipe as the 0.5Mbps users, so we can expect to see some pipe resizing going on, if a lot of users transfer to the Home 1000 service.  You may also see the pipe referred to as the backhaul, PVC or Virtual Path. BT at most exchanges has capacity installed for up to 155Mbps of traffic from ADSL users, and the smaller subtended exchange builds have around 30Mbps of bandwidth available. Which should be sufficient for most exchanges. 2. DEFINITION OF SERVICE
For purposes of this Agreement, the term &amp;quot;Service&amp;quot; shall mean the Mr PC Fixit Online PC Services service, including all technical support, usenet newsgroups, email and other features, products and services provided by Mr PC Fixit under the service option that you have selected. The Service may be referred to as, &amp;quot;Remote Computer Support&amp;quot;, &amp;quot;Virtual On&#45;Site Computer Support Service&amp;quot;, &amp;quot;On&#45;Site Computer Support Service&amp;quot;, &amp;quot;Online Computer Support&amp;quot;, &amp;quot;Drop&#45;Off Computer Support&amp;quot; or &amp;quot;Mr PC Fixit Online PC Services&amp;quot;. As part of the Service, Mr PC Fixit may license to you, or assist you in licensing from third parties, software (see Section 6 below).

3. AUTHORIZED USER, USE, AND RESPONSIBILITIES
3.1 You represent that: (i) you are 18 years of age or older and you have the legal capacity and authority to bind yourself and your employer, as applicable, to this Agreement; (ii) you consent on behalf of yourself and/or as an authorized representative of your employer, as applicable, to be bound by this Agreement; and (iii) the information you supply to us is correct and complete. You understand that Mr PC Fixit relies on the information you supply and that providing false or incorrect information may result in Service withholding or delays or the suspension or termination of your customer account. You agree to promptly notify Mr PC Fixit whenever your personal or billing information changes (including for example, your name, address, telephone number, and credit card number and expiration date).

3.2 You agree that you are responsible for all use on your account, including any secondary accounts or sub&#45;accounts registered to your primary account. You understand this means that you accept full liability and responsibility for the actions of anyone who uses the Service via your account, or any secondary accounts, with or without your permission.

3.3 If you select a service plan, not including subscription plans, that includes a pre&#45;determined allocation of Services (for example, pre&#45;purchasing 5 hours of Remote Computer Support Service), unused allotment of Services will remain in your customer account until used. If you select a subscription service plan that includes a pre&#45;determined allocation of Services (for example, purchasing a $24.95 per month Individual Subscription Plan), minutes will accumulate on a monthly basis and roll&#45;over from month to month if unused, but will expire at the end of the 12 month subscription period. You may use your account for up to four log&#45;on sessions per appointment at any time. You may use more than one IP address for each log&#45;on session.

3.4 If you pre&#45;purchase or subscribe to any Mr PC Fixit Services: You may not resell the Service, use it for high volume purposes, or engage in other similar activities, or use it as a virtual support center, as determined solely by Mr PC Fixit.

3.5 If you purchase a PC SmartPlan subscription service plan (&amp;quot;SmartPlan&amp;quot for one computer, you may only use the Service in connection with the computer listed in your service plan, unless you upgrade your service plan contract to include an additional computer or device. You hereby acknowledge and agree that a SmartPlan service contract covers only the software, hardware and peripherals specifically listed in the Product Description. The Product Description is not an exhaustive list, and Mr PC Fixit may modify it any time. Mr PC Fixit reserves the right to charge an additional fee to perform Services that you request that are not covered by the SmartPlan, or to refuse to perform such service. As part of the SmartPlan, Mr PC Fixit may require you to install certain software to assist Mr PC Fixit in the provision of the Services. Mr PC Fixit reserves the right to terminate this Agreement if you (i) do not agree to install the software on your PC; or (ii) alter, modify or disable the software, or its settings or configurations.

4. PRIVACY POLICY
Your privacy is important to Mr PC Fixit. Mr PC Fixit will treat your personal information in accordance with its current Privacy Policy, subject to change from time to time. You agree to the terms of the Privacy Policy, which describes Mr PC Fixit&apos;s use and disclosure of information about you, your account and your use of the Service. To ensure customer service and quality assurance, all remote computer sessions and telephone calls with Mr PC Fixit personnel will be recorded, stored, and monitored.

5. AVAILABILITY OF SERVICE
5.1 The Service you select may not be available at all times, and may not be available in the format generally marketed, and some personal computers may not be able to receive the Service even if initial testing showed that your connection was qualified or your computer environment was suitable. For Remote Computer Support, we will qualify your Internet connection for the minimum line rate (speed) available for support based on our standard line qualification procedures. The SmartPlan requires Internet access; it is your responsibility to ensure that you have adequate connectivity to the Internet. All Services are provided on an AS IS basis. Line rate, access and availability of Service are not guaranteed.

5.2 Mr PC Fixit or its suppliers may, at any time, without notice or liability, restrict the use of the Service or limit its time of availability in order to perform maintenance activities and to maintain session control.

5.3 If you subscribe to a SmartPlan, Mr PC Fixit will use commercially reasonable efforts to schedule a mutually convenient service session within a reasonable period of time. However, you hereby acknowledge that circumstances outside of Mr PC Fixit&apos;s control (e.g., a large scale outbreak of a new computer virus) may cause significant delays in Mr PC Fixit&apos;s ability to schedule a service session. You hereby release Mr PC Fixit from any and all liability, and agree that Mr PC Fixit shall not be liable to you or any third party for any direct or indirect damages, resulting from such delays.

6. SOFTWARE LICENSES AND THIRD PARTY SERVICES
6.1 In connection with our Service, we may provide to you, via download, CD, other media, or other delivery method the use of certain software which is owned by Mr PC Fixit or its third party licensors, providers and suppliers, and which may be provided free or for a fee, including client and/or network security software (&amp;quot;Software&amp;quot. We reserve the right to update or change the Software from time to time and you agree to cooperate in performing such steps as may be necessary to install any updates or upgrades to the Software. You may use the Software only as part of or for use with the Service and for no other purpose.

6.2 The Software may be accompanied by an end user license agreement from Mr PC Fixit or a third party. Your use of the Software is governed by the terms of that license agreement and by this Agreement, where applicable. You may not install or use any Software that is accompanied by or includes an end user license agreement unless you first agree to the terms and conditions of the end user license agreement.

6.3 With regard to any Software for which your acceptance of a separate license agreement is not required ( &amp;quot;Mr PC Fixit Software&amp;quot; ), you are hereby granted a revocable, non&#45;exclusive, non&#45;transferable license by Mr PC Fixit to use the Mr PC Fixit Software (and any corrections, updates and upgrades). You may not make any copies of the Mr PC Fixit Software. You agree that the Mr PC Fixit Software is the confidential information of Mr PC Fixit or its third party licensors, providers or suppliers, which you shall not disclose to others or use except as expressly permitted herein. The Mr PC Fixit Software contains copyrighted material, trade secrets, patents, and proprietary information owned by Mr PC Fixit or its third party licensors, providers, or suppliers. You may not de&#45;compile, reverse engineer, disassemble, attempt to discover any source code or underlying ideas or algorithms of the Mr PC Fixit Software, or otherwise reduce the Mr PC Fixit Software to a human readable form, modify, rent, lease, loan, use for timesharing or service bureau purposes, reproduce, sublicense or distribute copies of the Software, or otherwise transfer the Mr PC Fixit Software to any third party. You may not remove or alter any trademark, trade name, copyright or other proprietary notices, legends, symbols, or labels appearing on or in copies of the Software. You are not granted any title or rights of ownership in the Mr PC Fixit Software. You acknowledge that this license is not a sale of intellectual property and that Mr PC Fixit or its third party licensors, providers or suppliers continue to own all right, title and interest, including but not limited to all copyright, patent, trademark, trade secret, and moral rights, to the Mr PC Fixit Software and related documentation, as well as any corrections, updates and upgrades. The Software may be used in the United States only, and any export of the Mr PC Fixit Software is strictly prohibited.

6.4 Third Party Software: As part of the Services, Mr PC Fixit may suggest that you acquire, install and use certain third party software ( &amp;quot;Third Party Software&amp;quot; ). Third Party Software is licensed to you by the respective owners or licensees of the Third Party Software. You must agree to the terms and conditions set forth by such owners or licensees before installing Third Party Software, whether Mr PC Fixit assists you in the acquisition, installation, and/or use of Third Party Software. Mr PC Fixit has no rights to the Third Party Software and does not license Third Party Software to you or make any representation or warranty regarding the Third Party Software.

6.5 We provide technical assistance and support for the Software and the Mr PC Fixit Software in accordance with our policies. To the extent that we provide technical assistance and support for Third Party Software or equipment, you must ensure that you comply with the terms and conditions under which you licensed such Third Party Software or purchased such equipment. We make no warranty that we are an authorized service provider for Third Party Software or for any equipment; it is your sole responsibility to determine if you require additional rights for us to provide such support, and if so, to acquire such rights. You acknowledge that support of Third Party Software or equipment by an unauthorized service provider may void any warranty made by the supplier of such Third Party Software or equipment.

6.6 Your license to use the Software and the Mr PC Fixit Software shall remain in full force and effect unless and until terminated by Mr PC Fixit, its third party licensors, providers or suppliers, or until your customer account is terminated. Upon termination of your customer account for any reason, you must cease all use of the Software and the Mr PC Fixit Software and immediately delete the Software and the Mr PC Fixit Software from your computer.

6.7 Other Third Party Agreements: As part of the Services, Mr PC Fixit may suggest certain third party services to you. If you choose to subscribe to or otherwise use any third party services, your use of any such services is subject to the terms of service of such third party service provider. You agree to comply with such provider&apos;s terms of service and that the third party provider is solely responsible for delivery of its service(s) to you and your use of them. Third party services include, but are not limited to technical support, portal, training, music, gaming and storage services that Mr PC Fixit may elect to make available from time to time. Violation of such third party provider&apos;s terms of service may, in Mr PC Fixit&apos;s sole discretion, result in the termination of your customer account and use of service.

7. TERM AND TERMINATION
7.1 Effective Date and Term. This Agreement goes into effect upon your acceptance of this Agreement as set forth in Paragraph 1 and shall continue, subject to the terms of this Paragraph, until terminated by either party as permitted by this Agreement. Billing for your remote, on&#45;site, drop&#45;off or telephone computer support service will apply on an &apos;as used&apos; basis.

7.2 Termination of Service.

7.2.1 Pay&#45;as&#45;you&#45;go or Subscription Service. If you are a pay&#45;as&#45;you&#45;go or subscription service customer, either you or Mr PC Fixit may terminate this Agreement without cause by giving thirty (30) days written notice to the other party. Activation or set&#45;up fees paid at the initiation of your service, if any, are not refundable. Termination by Mr PC Fixit shall be effective thirty (30) days after the date of notice to you, except as otherwise provided in this Agreement. In the event of termination by Mr PC Fixit, for any reason, you will be required to pay the remaining balance of the charges applicable to your Service through the effective date of termination. You understand and agree that any software that you acquire and install as part of the SmartPlan may cease to operate, update or function properly after termination of the SmartPlan.

7.2.2 Termination and/or Suspension by Mr PC Fixit. If, in the sole discretion of Mr PC Fixit: (a) you are in breach of any of the terms of this Agreement (including but not limited to all policies regarding abuse and acceptable use of the Service) or any license for Third Party Software; (b) your use of the Service is prohibited by law or is disruptive to, adversely impacts or causes a malfunction to the Service, Mr PC Fixit&apos;s network, or the use and enjoyment of other users; (c) Mr PC Fixit receives an order from a court to terminate your Service; (d) if Mr PC Fixit for any reason ceases to offer the Service; (e) if you are no longer a Mr PC Fixit customer, or (f.) Mr PC Fixit determines that you are abusing the Service or using the Service excessively then, Mr PC Fixit at its sole election may terminate or suspend your Service immediately without notice.

7.2.3 Terminated Account. Mr PC Fixit, in its sole discretion, may refuse to accept your request for service, renewal or re&#45;subscription following a termination or suspension of your use of the Service.

8. PRICING AND PAYMENT
8.1 Pricing and Fees. Mr PC Fixit fees and charges for the Service(s) you select are supplied to you during the ordering process and are available on the Mr PC Fixit web site at Service Options unless otherwise provided for in this Agreement. You agree to pay the charges applicable to your selected Service plan, as well as any, applicable taxes and other charges including but not limited to activation fees, minimum service fees, no&#45;show fees, fail to cancel fees, termination fees, other nonrecurring charges and set&#45;up fees. You also agree to pay any additional charges or fees applied to your billing account for any reason, including but not limited to, interest, and charges due to insufficient credit or insufficient funds. Set up fees, activation fees, installation fees and other non&#45;recurring fees, if applicable, will be included in your first bill. Monthly recurring charges (subscription plans) will be billed one month in advance; usage charges will be billed in arrears, and pre&#45;purchase plans will be billed in advance, if applicable. Mr PC Fixit or its agent will bill you directly, or charge your credit card, as you request and as approved by Mr PC Fixit. Mr PC Fixit does not accept debit cards for payment of any charges or fees.

8.2 Discontinuation of Service for Nonpayment. Service to you may be denied or discontinued without notice at any time in the placement of Service charges on your credit card, or your credit card provider denies or discontinues providing credit to you for any reason, or you fail to make payment when due or provide us with a new credit card expiration date before the existing one expires.

8.3 Late Fees. If any portion of your bill is not paid by the due date, Mr PC Fixit may charge you a late fee on unpaid balances and may also terminate or suspend your Service without notice. The late fee will be the lesser of five percent (5%) per month, or the highest rate permitted by law. In the event Mr PC Fixit utilizes a collection agency or resorts to legal action to recover monies due, you agree to reimburse us for all expenses incurred to recover such monies, including attorneys&apos; fees.

8.4 Local telephone, Toll and Long Distance Charges. Whether you are accessing the Service from your home or away from your home, you are responsible for all telephone charges.

8.5 You have the option to change your Service(s) at any time by notifying us, provided that you qualify for and comply with any requirements of the changed Service.

8.6 Missed Appointments. If you do not contact Mr PC Fixit a minimum of two (2) hours prior to your appointment to cancel or otherwise reschedule your appointment, you will be charged, at Mr PC Fixit&apos;s option, a missed appointment fee according to the following schedule: Physical On&#45;Site Computer Support: &amp;pound;45.00 missed appointment fee Remote Computer Support: &amp;pound;25.00 service fee that is converted into 15 minutes of remote support and added to your account for future use

8.7 Service Without Resolution. Mr PC Fixit will make every reasonable attempt to troubleshoot, analyze, assess, correct or otherwise fix your computer or network problem. If Mr PC Fixit is unable to resolve your computer problem, you will still be liable for charges for time spent by Mr PC Fixit in an attempt to correct a problem.

8.8 Unable to Create Online Connection. Mr PC Fixit will not charge you if Mr PC Fixit cannot connect with your computer in attempt to provide remote computer support service.

8.9 The waiver of any fees or charges lies solely at the discretion of Mr PC Fixit.

8.10 Mr PC Fixit reserves the right to charge service fees to a customer&apos;s credit card up to eight (8) weeks after the conclusion of service.

9. LIMITATIONS ON USE OF THE SERVICE
9.1 You agree that your use of the Service and the Internet, without limitation, is your sole responsibility, is solely at your own risk, and you will comply with all applicable local, state, national and international laws and regulations.

9.2 You agree that the Internet is not owned, operated or managed by, or in any way affiliated with Mr PC Fixit and Mr PC Fixit is not responsible and has no control over the information, content or other materials, some of which may be offensive, malicious or destructive in nature, which may be accessed through use of the Service. You further agree that Mr PC Fixit does not own or control all of the various facilities and communications lines through which service may be provided, nor does Mr PC Fixit guarantee access to or through websites, servers or other facilities on the Internet, whether or not such facilities are owned or controlled by Mr PC Fixit.

9.3 You agree that Mr PC Fixit cannot and does not guarantee or warrant that data available for downloading through the Service will be free of defects, infection or viruses, worms, Trojan horses or other code that manifest contaminating, malicious or destructive properties. You are responsible for implementing adequate procedures to satisfy your particular requirements for accuracy of data input and output and for maintaining a means external to the Service for the reconstruction of any lost data.

9.4 You agree that the Internet is not a secure network and that third parties may be able to intercept, access, use, or corrupt the information you transmit or receive over the Internet. Mr PC Fixit is not responsible for invalid destinations, transmission errors, or corruption or security of your data.

9.5 You are not authorized to use any Mr PC Fixit name or mark (including &apos;Plum Choice&apos;) as a hypertext link to any Mr PC Fixit Web site or in any advertising, publicity or in any other commercial manner without the prior written consent of Mr PC Fixit. You understand that your ability to link to a Web site through the Service does not, in any way, represent or imply Mr PC Fixit&apos;s approval of, or its determination of the quality of that product or service, and that links are provided for your convenience only. The links provided through the Service are maintained by their respective organizations, which are solely responsible for their content. Mr PC Fixit Affiliates may use the Mr PC Fixit name and link to the Mr PC Fixit web site solely in accordance with the terms and conditions of the Mr PC Fixit Affiliate Program.

10. WARRANTIES AND LIMITATION OF LIABILITY
10.1 YOU ACKNOWLEDGE AND AGREE THAT THE SERVICE SUPPLIED HEREUNDER IS PROVIDED ON AN &amp;quot;AS IS&amp;quot; OR &amp;quot;AS AVAILABLE&amp;quot; BASIS, WITH ALL FAULTS. EXCEPT AS OTHERWISE SPECIFICALLY SET FORTH IN THIS AGREEMENT AND AS OTHERWISE SPECIFICALLY SET FORTH IN ANY MANUFACTURER WARRANTY FOR ANY EQUIPMENT OR SOFTWARE PROVIDED BY Mr PC Fixit (BUT ONLY IF SUCH WARRANTY IS INCLUDED WITH SUCH EQUIPMENT OR SOFTWARE), Mr PC Fixit (AND ITS OFFICERS, EMPLOYEES, PARENT, SUBSIDIARIES, AND AFFILIATES), ITS THIRD PARTY LICENSORS, PROVIDERS AND SUPPLIERS, INCLUDING GLOBAL SERVICE PROVIDERS (GSPS), DISCLAIM ANY AND ALL WARRANTIES FOR THE SERVICE, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON&#45;INFRINGEMENT, NON&#45;INTERFERENCE, TITLE, COMPATIBILITY OF COMPUTER SYSTEMS, INTEGRATION, AND THOSE ARISING FROM COURSE OF DEALING, COURSE OF TRADE, OR ARISING UNDER STATUTE. NO ADVICE OR INFORMATION GIVEN BY Mr PC Fixit OR ITS REPRESENTATIVES SHALL CREATE A WARRANTY. USE OF Mr PC Fixit COMPUTER SUPPORT IS AT YOUR OWN RISK AND IS NOT WARRANTED.

10.2 Mr PC Fixit DOES NOT WARRANT THAT THE SERVICE PROVIDED BY Mr PC Fixit WILL PERFORM AT A PARTICULAR SPEED, BANDWIDTH OR DATA THROUGHPUT RATE, OR WILL BE UNINTERRUPTED, ERROR&#45;FREE, SECURE, OR FREE OF VIRUSES, WORMS, OR THE LIKE. Mr PC Fixit SHALL NOT BE LIABLE FOR LOSS OF YOUR DATA, OR IF CHANGES IN OPERATION, PROCEDURES, OR SERVICES REQUIRE MODIFICATION OR ALTERATION OF YOUR EQUIPMENT, RENDER THE SAME OBSOLETE OR OTHERWISE AFFECT ITS PERFORMANCE. Mr PC Fixit MAKES NO WARRANTY REGARDING ANY TRANSACTIONS EXECUTED USING THE SERVICE OR THE INTERNET. Mr PC Fixit MAKES NO WARRANTY REGARDING THE CONTENT AND INFORMATION ACCESSED BY USING THE SERVICE OR ANY LINKS DISPLAYED. YOU EXPRESSLY ASSUME ALL RISK AND RESPONSIBILITY FOR USE OF THE SERVICE AND THE INTERNET GENERALLY. DO NOT USE THE SERVICE IN ANY HIGH RISK ACTIVITIES WHERE DAMAGE OR INJURY TO PERSON, PROPERTY, ENVIRONMENT, OR BUSINESS MAY RESULT IF AN ERROR OCCURS.

10.3 IN NO EVENT SHALL Mr PC Fixit (OR ITS OFFICERS, EMPLOYEES, PARENT, SUBSIDIARIES, OR AFFILIATES), ITS THIRD PARTY LICENSORS, PROVIDERS OR SUPPLIERS, INCLUDING GSPS, BE LIABLE FOR: (A) ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING WITHOUT LIMITATION, LOST PROFITS OR LOSS OF REVENUE OR DAMAGE TO DATA ARISING OUT OF THE USE, PARTIAL USE OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, INCLUDING WITHOUT LIMITATION, THOSE ARISING UNDER CONTRACT, TORT, NEGLIGENCE OR STRICT LIABILITY, EVEN IF Mr PC Fixit HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH CLAIM OR DAMAGES, OR (B) ANY CLAIMS AGAINST YOU BY ANY OTHER PARTY.

10.4 ALL LIMITATIONS AND DISCLAIMERS STATED IN THIS PARAGRAPH ALSO APPLY TO Mr PC Fixit&apos;S THIRD PARTY LICENSORS, PROVIDERS AND SUPPLIERS, INCLUDING GSPS, AS THIRD PARTY BENEFICIARIES OF THIS AGREEMENT.

10.5 ANY RIGHTS OR LIMITS STATED HEREIN ARE THE MAXIMUM FOR WHICH Mr PC Fixit (AND ITS OFFICERS, EMPLOYEES, PARENT, SUBSIDIARIES, AND AFFILIATES), Mr PC Fixit&apos;S THIRD PARTY LICENSORS, PROVIDERS AND SUPPLIERS, INCLUDING GSPS, ARE COLLECTIVELY RESPONSIBLE.

10.6 THE REMEDIES EXPRESSLY SET FORTH IN THIS AGREEMENT ARE YOUR SOLE AND EXCLUSIVE REMEDIES. YOU MAY HAVE ADDITIONAL RIGHTS UNDER CERTAIN LAWS (SUCH AS CONSUMER LAWS), WHICH DO NOT ALLOW OR LIMIT THE EXCLUSION OF IMPLIED WARRANTIES, OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, OUR EXCLUSIONS OR LIMITATIONS APPLY TO YOU TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW.

10.7 Mr PC Fixit RESERVES THE RIGHT TO PURSUE ANY AND ALL LEGAL AND EQUITABLE CLAIMS AGAINST YOU PERTAINING TO YOUR USE OR MISUSE OF THE SERVICE OR FOR YOUR BREACH OF THE AGREEMENT (INCLUDING ANY POLICIES RELATING TO THE SERVICE.)

11. INDEMNIFICATION
You agree to defend, indemnify and hold harmless Mr PC Fixit from and against all liabilities, costs and expenses, including reasonable attorney&apos;s fees, related to or arising from: (a) any violation of applicable laws, regulations or this Agreement by you (or any parties who use your account, with or without your permission, to access the Service); (b) the use of the Service or the Internet or the placement or transmission of any message, information, software or other materials on the Internet by you (or any parties who use your account, with or without your permission, to access the Service); (c) negligent acts, errors, or omissions by you (or any parties who use your account, with or without your permission, to access the Service); (d) injuries to or death of any person and for damages to or loss of any property, which may in any way arise out of or result from or in connection with this Agreement, except to the extent that such liabilities arise from the active negligence or willful misconduct of the other party; or (e) claims for infringement of any intellectual property rights arising from the use of the Service, Software, or the Internet.

12. NOTICES
12.1 Notices required under this Agreement by you shall be provided to the Mr PC Fixit Customer Service Department. Notices by Mr PC Fixit to you shall be deemed given: (a) when sent to your registered email address, or (b) when deposited in the United States mail addressed to you at last&#45;known address or (c) when hand delivered to your home, as applicable. Notice of changes to this Agreement and these Terms of Service will be deemed given upon posting to the pages on the Website.

12.2 With regard to electronic communications, you and Mr PC Fixit further agree that: (a) the User ID and/or alias of a sender, contained in an electronic communication (&amp;quot;email&amp;quot, is legally sufficient to verify the sender&apos;s identity and the authenticity of the communication; (b) an email sent containing your User ID and/or alias establishes you as its originator and has the same effect as a document with your written signature on it; and (c) an email or any computer printout of it, is a valid proof of the validity of the original content of the electronic communication.

13. GENERAL PROVISIONS
13.1 All obligations of the parties under this Agreement, which, by their nature, would continue beyond the termination, cancellation or expiration of this Agreement, including by way of illustration and not limitation, those clauses relating to Software Licenses, Warranties and Limitation of Liability, and Indemnification, shall survive such termination, cancellation or expiration.

13.2 Mr PC Fixit will not be liable for delays, damages or failures in performance due to causes beyond its reasonable control, including, but not limited to, acts of a governmental body, acts of God, acts of third parties, fires, floods, strikes or other labor&#45;related disputes, of other things we do not control, or an inability to obtain necessary equipment or services.

13.3 You agree not to assign or otherwise transfer, this Agreement in whole or in part, including the Software or your rights or obligations under it. Any attempt to do so shall be void. We may assign all or any part of this Agreement without notice and you agree to make all subsequent payments as directed.

13.4 You and Mr PC Fixit agree that the substantive laws of the Commonwealth of Massachusetts, without reference to its principles of conflicts of laws, will be applied to govern, construe and enforce all of the rights and duties of the parties arising from or relating in any way to the subject matter of this Agreement. YOU AND Mr PC Fixit CONSENT TO THE EXCLUSIVE PERSONAL JURISDICTION OF AND VENUE IN A COURT LOCATED IN MIDDLESEX COUNTY, MASSACHUSETTS FOR ANY SUITS OR CAUSES OF ACTION CONNECTED IN ANY WAY, DIRECTLY OR INDIRECTLY, TO THE SUBJECT MATTER OF THIS AGREEMENT OR TO THE SERVICE. Except as otherwise required by law, including Massachusetts laws relating to consumer transactions, any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. In any action or proceeding arising from or relating in any way to the subject matter of this Agreement you agree that Mr PC Fixit shall be entitled to recover its reasonable attorneys� fees and costs incurred in connection with said action or proceeding and in the event that Mr PC Fixit prevails.

13.5 Use, duplication or disclosure by any Government entity is subject to restrictions set forth, as applicable, in subparagraphs (a) through (d) of the Commercial Computer&#45;Restricted Rights clause at FAR 52.227&#45;19, FAR 12.212, DFARS 227.7202, or in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause of DFARS 252.227&#45;7013, and in similar clauses in the NASA FAR Supplement. Contractor/manufacturer is Mr PC Fixit or its licensors and suppliers. The use of Software and documentation is further restricted in accordance with the terms of this Agreement.

13.6 In the event of a conflict between this Agreement and any applicable tariff, the tariff shall prevail. We reserve the right to modify the Service to reflect any change in any applicable tariff or underlying network service or component affecting the Service.

13.7 Mr PC Fixit&apos;s failure at any time to insist upon strict compliance with any of the provisions of this Agreement in any instance shall not be construed to be a waiver of such terms in the future. If any provision of this Agreement is determined to be invalid, illegal or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby, and the unenforceable portion shall be construed as nearly as possible to reflect the original intentions of the parties.

13.8 This Agreement, including all Attachments and all other policies posted on the Website, which are fully incorporated into this Agreement either by attachment or by reference, constitutes the entire agreement between you and Mr PC Fixit with respect to the subject matter hereto and supersedes any and all prior or contemporaneous agreements whether written or oral. Any changes by you to this Agreement, or any additional or different terms in your purchase orders, acknowledgements or other documents, written or electronic, are void.</description>
